help with hayes nine's?

hey i just got my bike today (used) and when i took it out of the box and went to put it together the disk wouldnt go into the caliper and i noticed it looked like there was only one pad and there was some fluid coming out..the disk wouldnt go in because there was a pin going across that was blocking it. i know this probably dosent make any sense but i need to fix these asap. should i just take the caliper assy apart and try to see whats going on?

Hayes 9's work fine after you put some blue loctite on the lever-engagement adjuster screw that's inside the lever blade. This keeps it from backing-off and making your lever looser and looser. See the 9's are the exact same brake as the Mags except for the lever. jake69, ignoring the melodrama, has some good points: Skip directly to step #5 and you're cool.
