I got $5 on Trek, although I'd like to think Weagle has a good shot if he's suing. Isn't he a genius that developed multiple suspension designs? He should know what he's doing.

I'm a betting man. Any takers? I will bet a 2010 Kona Stinky Deluxe 650b bike that I recently built ($4400 value)
in xlnt condition w/ White Bros. Groove 200 fork & Hammerschmidt transmission. I am betting on Dave Weagle. If you lose I will take only $2,000 cash. If I lose, you get the bike.
Loser must pay within 24hrs. Go Dave!

    this...

"But while the concentric pivot is the most noticeable feature of both designs, in itself the pivot is not even patentable that innovation dates to the early 20th or even late 19th century. The Trek and Split Pivot patents differ in the ways the rear suspension linkages connect to the front triangle and the shock."

The bigger bank account usually wins out in suits like this. Definitely not a clearly defined patent infringement, very murky in all aspects seeing there is prior art over a century old on most of the pivot claims.

It appears that DW just wants some royalties, unfortunately if he does "win" them he will probably have spent way more on lawyers than Trek will ever give him in royalties.

PS- If he shaved once in a while and didn't come off like a vaginal cleaning bag so often he would probably have better luck. Nobody like a scruffy, pudgy, vaginal cleaning bag!

PPS- Yeah, ****** bag is blocked.

PPPS- DW suspension designs do work pretty damn well though.

No stinky has a value of $4400 regardless of part selection, lol.

Does this mean that Trek is going to get sued by Specialized ....I think own the right to trample smaller companies in this industry.

A trial that goes by JURY, IMO is about 80% accurate to what the general public
thinks about the two sides, when all is said and brought out. If indeed fat Dave Weagle
did have that meeting with Trek about his rear end and Trek quickly put out
"their" version of it after a few months, then it looks pretty bad for Trek. Also I shouldn't
make a bet with anyone on the DH forum, nobody here has any money

LOL. If you believe that one sided story posted by Dave himself, I have a bridge to sell you....

There's usually more to the story.

I agree. I like rooting for the underdog, but who's to say which side is right? You can't root for either one just because you think "corporations" are evil. Trek has every right to defend itself just as DW has every right to protect his patent. None of us boobs knows a damn thing. All I know is DW link suspension kicks ass and Trek makes nice bikes. Otherwise, I'll wait for the facts.

Trek will settle for a reasonable sum in the next 1-3 years. The price will go up as the trial date approaches.

that assumes their gaggle of lawyers can't punch holes in his claims, and that his claims are based entirely on provable fact.

Pretty big assumptions. I'd guess they'd sooner offer him "go away" money and let the lawyers drag their feet until the money's gone.

I always wondered how Trek made such a big change in there suspension design. They went from having some of the worst DH designs to one of the best in just one year. It will be interesting to see how this plays out.

If what Dave Weagle said in his complaint has the slightest ring of truth in it, I can see this being a $5-10M case for him. 'Course, I have no idea what the economics of the bicycle industry is. Is it still a $600M company? The firm is probably doing it on contingency, so the litigation expenses are not coming out of his pocket.

That's list price circa 2010. You always highball merch! Used, yeah like ALL BIKES
Turners included are 50% off list the moment it rolls out the bike shop.

But seriously who has $2,000 that they want to bet? I need money.

If Weagle's case can survive a motion for summary judgment, he'll get a settment. Trek doesn't want a trial - and the accompanying transcript - on the public record.

Then Weagle will be able to take a nice vacation . . .
