    New question here. Are En1078 Helmets legal in the US?

    So I wound up with a free new helmet that has an EU certification of "En1078:1997+A1 : 2005". I'd like to sell it to get rid of it, but I don't even know if its even legal in the US. Am I better off just tossing it? Not sure what to do with it. Its huge and doesn't fit me.

    In the U.S. you can wear a bucket on your head, if you want to (and carry a gun with it!). I'm sure we will get over regulated, but for now I think you can try to sell anything you want.

    There's no law requiring a bicycle helmet meet any standard for recreational cycling. Can you sell it? Probably. Should you? I wouldn't buy a used helmet, there's just no way to know it's history.

    Its not used. Its fresh from the factory. I tried it on once and it didn't fit, so I put it back in the box it came in.

    But that size is not right at all. I'm a medium and the helmet is definitely a large. Its nice though, it just doesn't fit me.

    On top of that, Its not even a law to wear helmet while riding a bike in most states unless you are a minor. Although its a good idea... since its not a law, there are no federal or state regulations that companies have to follow.

    Yes, you can sell the helmet.

    Just give this guy a clear cut answer without any additional information. There seem to be some issues.

    Unless marked otherwise, the helmet doesn't necessarily pass the US DOT or CPSC standards. You probably don't want to import a container of them and start selling them at Dick's or whatever, but selling it as a private party shouldn't be a problem.

    If you (or the buyer) are planning on racing in the helmet, you'll definitely want to look into the race organizer's helmet rules. For example, the helmet won't be legal for your typical USAC race - Policy I: Helmets - USA Cycling

    I've never had my helmet checked at a race though, so unless it's a really-well-known-only-available-as-a-CEN-helmet model (some of the Catlike helmets might fall into this category), I'm guessing nobody is likely to say anything.
