Issue with Trek Remedy 66- would like your opinion

Hey. I have couple questions. I have an 06 Trek remedy 66. I just bought it used, and there's a strange issue. The swing arm touches the bb shell( I have an outboard bb shell- came stock with the bike). It only touches on the non-drive side. Everything is stock including the shock.
My second question is Trek's warranty transferable?
Thanks a lot for the help!

Pretty sure the trek warranty isn't transferable,
Re the contact problem... that's odd. Is it defiantly a remedy chainstay on the bike- not been replaced with anything else?
Have you checked the amount of bottom bracket spacers is correct? Might change something. It'd be easier to diagnose if you could post a picture? I cant think what the lower bit of the suspension looks like...

Maybe it isnt a stock shock, and the eye-to-eye distance is too long, causing the travel to essentially "over extend" ?

Hi. Thanks for the help! Here's a picture to explain it a bit better. I placed duct tape to keep it from damaging.
