    If it had a pivot at the intersection of the upper link and seat tube as pictured it would almost be a 6-bar Felt Virtual Link.

    Only if the patent assignee wants to spend the money to go after the infringing party. Not likely in the case you suggest.

    In drug development that would fall under the Safe Harbor Provision 35USC 271(e)(1) of the Hatch-Waxman Act and the recent Merck v Integra Case Law; so R&D for drug development is not considered an infringement BUT it is not a drug so it very well could be considered infringement.

    Do you think it costs more to buy the rights to Horst than they already pay for the VPP?

    Six of one, half dozen of the other perhaps.

    EDIT: maybe the bottom pivot makes it NOT a Horst?

    It's technically Horst, that's why they went VPP to avoid the licensing costs from Specialized as I understood it.
