upgarding 13' Rockhopper comp crankset ??

Long story short, found out my 2nd gear is bent and shop will probably not warranty it as it's been 2-3 weeks since bough it, might argue that it is something I did. Anyway if they can't/ won't warranty it looking to upgrade the crank set and bottom bracket. I was at the LBS the guy in the work shop suggest Shimano Deore,Is this a worth while upgarde or should I spend more?

I notice the teeth count is different from my stocker how will this change things. What's funny is I went on Shimano website and only see cranksets for 10 speeds. Do they not make 9 speeds stuff anymore or something?

I am open to suggestions as well. I'm just getting in to the sport and still learning. I would like to get a chain guard/bash guard as well.

Also since my cassette is 9 speed, the deore are 10 speeds...are they compatible? 10 speed chains are different size (gears are cut deeper than 9)

    Stock : 44/32/22, steel

    Shimano: 42 32 24

Edit: I have a 2013 Rockhopper Comp 29er. All stock other than pedals.

    SR Suntour XCR, 9-speed, Octalink

    CHAINRINGS
    44/32/22, steel
