Still have the Rush noise when pedaling...

Hi, I still have this noise on my 06 Rush 600 when pedaling hard and the pedal/crank arm on the drive side is around the 12 o'clock position. Here is what I've done:
Disassemble pivot and shock mounts and lubed
disassembled crankset and ring gears and lubed
    replaced outer bearing cups
    torqued everything
everything on the CD noise bulletin
    replaced wheelset
    lubed cable guides
    rebuilt pedals
I'm really at a loss and I think it may be one of those bad rear swing arm problems. Any ideas? Will Cannondale allow me to exchange it or will I have to go through a dealer? I ask because I got the bike in San Francisco and I'm in Germany right now.

On the shock mounts, did you remove the spacers? Mine had some "grit" in between the spacer and shock. After removing the spacers, cleaning, and re-inserting, the noise went away, hasn't been back for a year.

Does this noise happen on rough surfaces and / or smooth ?

Oh yeah, like Dan Gerous said, seat rails, seat post. Forgot those. And after fixing mine, we had a "click" on the girlfriend's rush we couldn't find even after disassembly of the shock, pivots, wheels, etc. I found it was just the seat rails. Of course all the work I did on hers was needed anyway. . .

It makes the noise when I pedal standing also so I don't think it's the seat post. It only happens when I'm pedaling hard, like up a hill, and the drive side pedal/crankarm goes past 12 o'clock. It's more of a click click click click. It sounds like a bearing or something going bad but I just replace the outboard bearing cups. If I had to guess I would say it's coming from the pivot area. I really like this bike and I find myself riding it less because of this noise.
Does anyone know the symptoms of the bad swingarm? Does this sound like it?

Fox has a recall on some RP3's because they were making a noise .
Do a search , it's somewhere on the board here or maybe someone
else can post more info on it .
