    No good Cannondale España

Cannondale's warranty in Spain does not take the problems of their bicycle frames Rush Carbon model 2010.
Bicycles by paid 6000 euros and are not in optimal conditions for use.
Where I can report ? thanks

Go to a different cannondale dealer, and keep writing cannondale.
Make sure you WRITE them since you can keep that for your records including their written responses.
As I remember correctly you guys in Euroland have a 2year warranty period, so cannondale can't refuse a warranty claim like this by law.
    Are you the original owner?
Do you still have your sales receipt?
Is this a European spec'd bike, purchased in your country?
If you answer any of the above questions with a "no" you will not get a replacement from them.
Looks like the swing arm's paint is actually worn on the left side...is it rubbing against the main frame?

Cannondale Spain but says it's normal, that is within the manufacturing tolerance

My '06 Cannondale Prophet is like that. Same with my buddy's '07 Rush. We've never encountered any problems with the asymmetrical spacing between the seat tube.

I own 2 Prophets and neither of them has uneven spacing, well not any that is visible to the naked eye. Granted, I haven't actually measured the gap but I am positive that it is no where near being off by that much.

You must persist!!! Did Cannondale give you that response directly or was it through the bike shop/dealer? Sounds like you are getting the runaround buddy. Keep persisting and slowly moving up the chain of command until you get this fixed.

Let us know how you make out.

Can the OP maybe confirm that the swing arm is rubbing against the frame's seat tube? If that's the case it's clearly a manufacturing defect and with all the paperwork and him being the original (first) owner it must be warrantied by cannondale.
If they give you a hard time you know what to do next time you buy a new bike.......

    This is the answer Cannondale:

    Good afternoon,

For this particular case, our engineering department has said that based on the photographs provided, the bicycle frame reference is within the manufacturing tolerance.

Remember that an apparent des-aligned seat tube height does not mean that the toe of the rocker are des aligned with respect to the vertical center plane of the bicycle, so that "look des aligned" does not imply that the east.

    Sincerely,

Can You tell when You ride the bike? Does it pull to one side? Or does the shock have a wear mark on one side of it? How long did You have the bike until You brought it up to the deler?

The frame is not 100% straight, but if it does not effect the ride or wear on the shock and it took You over a year to notis it why should it be warrantied? The bike has not broken, ride it until it breaks then go for a warranty clame.

From the fist picture I can see clearly that the seat tube is rubbing on the swingarm, and I would not ride the bike in this condition. This might lead to a failure in either of the parts.

Send cannondale the second picture again, but use the macro mode on you camera.

You do not pay a premium price, and expect those sorts of "tolerances."

I would not be happy at all if that was my bike!

I had a jelkll, (years ago) with the same problem, I think it is a regular item on cannondale, but would have to cover the guarantee, the price of that bike demands it
